1/3 Rule of Salary Calculator (Kenya)
Ensure payroll compliance under Employment Act s.19(3) by protecting at least one-third of gross salary.
What is the one-third rule of salary in Kenya?
The one-third rule (sometimes called the 1/3 rule or a third rule) comes from section 19(3) of Kenya's Employment Act. It says the total of all deductions from an employee's wages cannot be more than two-thirds of those wages. So whatever is deducted, you must take home at least one-third of your salary in cash. One-third rule questions
What is the one-third rule of salary in Kenya?
The one-third rule comes from section 19(3) of the Employment Act. All deductions from your pay together, including PAYE, NSSF, SHIF, the Housing Levy, loans and SACCO contributions, cannot be more than two-thirds of your wages. In other words, you must take home at least one-third of your salary.
What is the maximum an employer can deduct from my salary?
Under section 19(3), total deductions cannot exceed two-thirds of your gross salary. On a KES 60,000 salary that is KES 40,000, so your employer must leave you with at least KES 20,000 as take-home pay.
Do PAYE, NSSF, SHIF and the Housing Levy count towards the one-third rule?
Yes. The limit applies to the total of all deductions, so statutory deductions count alongside loans, salary advances, SACCO contributions, HELB repayments and insurance premiums.
How do banks and SACCOs use the one-third rule?
Before approving a check-off loan, lenders check that your net pay after the new repayment will still be at least one-third of your salary. Many lenders work from basic pay rather than gross pay, so ask your lender which figure they use.
What can I do if my deductions break the one-third rule?
Raise it with your HR or payroll team first, since the employer has to rearrange deductions so you keep at least a third. If it is not fixed, you can report it to the labour officer at your county labour office.
